1. Acceptance of Terms

Welcome to Employko, a comprehensive Human Resources Information System (HRIS) developed and operated by Eurekasoft. By accessing or using Employko (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform.

These Terms constitute a legally binding agreement between you (the "User" or "you") and Eurekasoft ("we", "us", or "Company"). Your organization's use of Employko is also subject to a separate service agreement between your organization and Eurekasoft.

2. Description of Service

Employko is a cloud-based HR management platform that provides the following services:

  • Personnel Management: Employee database, organizational structure, job positions, and roles
  • Leave Management: Vacation requests, sick leave tracking, time-off balances, and approvals
  • Document Management: Storage and management of employee documents, contracts, and certificates
  • Performance Management: Performance reviews, goal tracking, and feedback systems
  • Payroll Support: Salary information and payroll-related data management
  • Reporting & Analytics: HR reports, dashboards, and data insights
  • Employee Engagement: Celebrations, announcements, and internal communications
  • Compliance: Tools to help maintain compliance with labor laws and regulations

3. User Accounts and Access

3.1 Account Registration

Access to Employko is provided through your organization. Your organization's HR administrator will create your account and provide you with login credentials. You are responsible for maintaining the confidentiality of your username and password.

3.2 Account Security

  • You must keep your login credentials secure and confidential
  • You are responsible for all activities that occur under your account
  • You must notify your HR department immediately if you suspect unauthorized access
  • You must not share your account with others or allow others to access the Platform using your credentials
  • We use JWT (JSON Web Token) authentication with automatic token expiration for security

3.3 Account Termination

Your account will be terminated when your employment with the organization ends, or at your organization's request. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Responsibilities and Conduct

When using Employko, you agree to:

  • Use the Platform only for legitimate HR and business purposes
  • Provide accurate and complete information
  • Comply with all applicable laws, regulations, and company policies
  • Respect the privacy and confidentiality of other users' information
  • Not attempt to gain unauthorized access to any part of the Platform
  • Not interfere with or disrupt the Platform's functionality
  • Not use the Platform to transmit harmful code, viruses, or malware
  • Not copy, modify, or distribute the Platform's content without authorization
  • Not reverse engineer or attempt to extract source code from the Platform

5. Data and Privacy

5.1 Data Collection and Use

We collect and process personal data as described in our Privacy Policy. By using Employko, you consent to the collection, use, and processing of your data as outlined in the Privacy Policy.

5.2 Data Ownership

Your organization retains ownership of all data entered into the Platform. We act as a data processor on behalf of your organization. Employee data is owned by the employing organization and subject to their data governance policies.

5.3 Data Security

We implement industry-standard security measures including encryption (SSL/TLS), role-based access control, regular security audits, and data backups. However, no system is completely secure, and you acknowledge that you use the Platform at your own risk.

6. Intellectual Property Rights

6.1 Platform Ownership

Employko, including all content, features, functionality, software, code, designs, graphics, logos, and trademarks, is owned by Eurekasoft and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your organization's internal business purposes. This license does not include the right to:

  • Sell, resell, or commercially exploit the Platform
  • Modify, copy, or create derivative works
  • Reverse engineer or decompile the Platform
  • Remove or alter any proprietary notices

7. Service Availability and Support

7.1 Service Availability

We strive to provide 99.9% uptime for Employko. However, we do not guarantee uninterrupted access and may need to perform maintenance, updates, or repairs. We will provide advance notice for scheduled maintenance when possible.

7.2 Technical Support

Technical support is provided to your organization's designated administrators. End users should contact their internal HR or IT department for assistance. Direct support can be requested at support@eurekasoft.eu.

8. Disclaimers and Limitations of Liability

8.1 "As Is" Basis

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 Limitation of Liability

To the maximum extent permitted by law, Eurekasoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from:

  • Your use or inability to use the Platform
  • Unauthorized access to or alteration of your data
  • Any data loss or corruption
  • System errors, bugs, or downtime
  • Any third-party conduct or content

8.3 Maximum Liability

Our total liability to you for all claims arising from or related to the Platform shall not exceed the amount paid by your organization for the Platform in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Eurekasoft, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your use or misuse of the Platform
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the new Terms.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

12. Termination

12.1 Termination by You

You may request account termination by contacting your organization's HR administrator.

12.2 Termination by Us

We may suspend or terminate your access to the Platform immediately, without prior notice, if:

  • You violate these Terms
  • Your organization's service agreement ends
  • We are required to do so by law
  • Your conduct poses a security risk or harms other users

12.3 Effect of Termination

Upon termination, your right to use the Platform will cease immediately. Data retention after termination is subject to our Privacy Policy and your organization's service agreement.

13. Compliance with Laws

You agree to comply with all applicable local, national, and international laws and regulations, including but not limited to:

  • Data protection laws (GDPR, etc.)
  • Labor and employment laws
  • Anti-discrimination laws
  • Export control laws
  • Copyright and intellectual property laws

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any disputes arising from these Terms or the Platform shall be resolved through good faith negotiations. If negotiations fail, disputes shall be submitted to the competent courts of Bulgaria.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any service agreement between your organization and Eurekasoft, constitute the entire agreement between you and us regarding the Platform.

18. Acknowledgment

By using Employko, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not access or use the Platform.
